CARO Centre takes part in National Access to Law Days (JNAD)

The National Access to Law Days (JNAD) were held on May 24 and 25, 2022. The CARO Centre was invited to take part in Saint-Martin in the day organised in partnership with the Interprofessional Consular Chamber of Saint-Martin (CCSIM), the Trait d'Union France Victimes 978 association, and the Bar Council of Guadeloupe, Saint-Martin and Saint-Barthélemy.
The aim of the JNAD, which were created by the French Ministry of Justice in 2018, is to improve access for litigants to legal professionals (lawyers, legal practitioners, notaries, etc.) across the entire French territory and Overseas Territories; and to highlight the Departmental Councils for Access to Law (CDAD) and Access Points to Law (PAD).
The two-day event featured a number of guests who spoke on the themes of domestic and family violence, and undeclared work. Slots were set aside for litigants to meet professionals with the skills to advise them: lawyers, legal practitioners, magistrates, gendarmes, a public prosecutor, the territorial police, notaries, CGSC, URSSAF, a chartered accountant, social worker, rights advocate, chair of an employers' association, etc.
The programme was as follows:
Morning of May 24
- Julien Bataille, director general of the CCISM, Maison des Entreprises, presented the introductory remarks.
- Robert Cario, legal practitioner, criminologist, Emeritus Professor of Criminology, founder of the Institut Français de la Justice Restaurative and Knight of the Order of Merit, gave a presentation on restorative justice, which creates space for dialogue and puts victims at the heart of the system. The aim is to provide the parties with a neutral framework and a space for discussion. Professor Cario highlighted the complementarity between this circle of extra-judicial restorative justice and traditional justice.
- Maître Tania Bangou, lawyer and president of the Bar of Guadeloupe, Saint-Martin and Saint-Barthélemy, gave a presentation on the legislative process that has led to the creation of a legal arsenal in terms of protection.
- Maître Evelyne Démocrite, lawyer, former president of the Bar of Guadeloupe, Saint-Martin and Saint-Barthélemy, looked back at recent legislation on domestic violence (protection orders, evicting a violent spouse, etc.), and explained the procedures that have been put in place.
- Olivier Fatou, president of the France Victimes association, Saint-Martin branch, spoke about the role of the association, the processes that have been set up, and the measures designed to protect and support victims.
- Viviana Ozio-Clavel, a psychologist at the association, spoke about the cycle of violence and psychological pressure. She also reviewed the support given to victims of criminal offences.
Afternoon of May 24
- Angèle Dormoy, chair of the Inter-consular Chamber of Saint-Martin and a business leader, gave the introductory remarks and shared her experience as a business owner in Saint-Martin.
- Olivier Fatou, president of the France Victimes association, Saint-Martin branch, shared his experience of supporting victims.
- Maître Sandrine Jabouley, lawyer at the Bar of Guadeloupe, Saint-Martin and Saint-Barthélemy and panel moderator, presented the legal framework of these subjects.
- Maître Beaubois, lawyer at the Bar of Guadeloupe, Saint-Martin and Saint-Barthélemy, Mr Lize, a chartered accountant, and Mr Schwartz from the Border Police (PAF), spoke on the theme of Undeclared Salaried Hobs.
- Maître Cabrera, lawyer at the Bar of Guadeloupe, Saint-Martin and Saint-Barthélemy, and Mr Schwartz from the PAF, shared their expertise on international mobility and the procedures for posting foreign workers.
- Ms Raspail from the CCISM and Mr Schwartz discussed undeclared practices.
- Maître Karine Linon, lawyer at the Bar of Guadeloupe, Saint-Martin and Saint-Barthélemy, spoke about undeclared work and addressed the issue of false subcontracting and verification procedures in the context of public procurement, as well as the financial solidarity of the project owner, with Mr Schwartz.
- Oliver Amourgon from the CGSS made a point about the checks on undeclared work and insolvency proceedings, as well as the consequences of undeclared contracts of employment.
- Maître Beaubois, lawyer at the Bar of Guadeloupe, Saint-Martin and Saint-Barthélemy, Mr Armougon from the CGSS and Mr Schwartz from the PAF discussed the authorities in charge of controlling and clamping down on undeclared work. Maître Beaubois also spoke about the social aspect and the role of the industrial tribunal.
- Mr Schwartz focused on controls in criminal matters.
- Oliver Amourgon from the CGSS reminded those present about the checks on undeclared work and insolvency proceedings, as well as the consequences of unreported contracts of employment.
- Maître Bon, a criminal lawyer at the Bar of Guadeloupe, Saint-Martin and Saint-Barthélemy, and Ms Hildebert gave a presentation on the theme of criminal prosecution.
Morning of May 25
The event on May 25 was held at CCISM's Maison des Entreprises. This open morning was an opportunity to bring together legal professionals (lawyers, gendarmes, police officers, a rights advocate, associations and a social worker) and to receive litigants and answer their questions.
The CARO Centre was able to meet business owners and leaders together with members of the CCISM and to present the Centre's services regarding arbitration, mediation, project mediation (facilitation) and expert assessment.
